The teacher will attend the student when he/she asks for it, via meeting to be agreed by sending a prior written petition to the following e-mail address: tdiciommo@uic.es.
The course aims to provide an eminently practical approach to arbitration as an "alternative dispute resolution” ( ADR).
Not required
The objectives are the following:
(i) To know the alternative methods of dispute resolution and their different application depending on the specific case.
(ii) To study the function of arbitration and its practical application.
(iii) Learning how to act in an arbitration as an arbitrator or as a defender of the interests of the parties.
The final goal it that the students acquire skills and knowledge in arbitration.
1. To know and understand the arbitration proceedings.
2. To develop the ability to synthesize and analyze the information obtained during the class and the supplementary material provided by the teacher.
3. To acquire skills for teamwork
4. Being able to find information, to interpret it and use it for solving practical cases or carrying out work on this matter.
The content of the subject is the following:
1. Introduction: arbitration as an alternative dispute resolution method.
2. Arbitration agreement.
3. Arbitration institutions.
4. Arbitrators.
5-. Precautionary measures.
6. The arbitral instance.
7. The arbitrator's decisions,
8. Res judicata, set aside and review of arbitral award.
9. Enforcement of arbitral award.
10. Enforcement of foreign arbitral award.

The final mark of the subject will be the result of a weighted average between the final exam and continuous assessment note:
(i) Continuous Assessment: Students must submit the practices that will be provided in class. This first part of the examination will mean the 50% of the final mark.
(ii) The final exam will consist of an examination, based on the contents analyzed. This final exam will account for 50 % of the final mark.
This evaluation system will be taken into account on the second call.
Considering the content of the subject, the working method and the peculiar way of assessing the course, students are free to use any basic manual of Arbitration.
In any case, it is recommended the following book: CREMADES SANZ-PASTOR: "El arbitraje de derecho privado en España", Tirant lo Blanch, Valencia 2014.
