En los últimos años los museos y, en general, las fundaciones, en cuanto entidades que administran museos, han adquirido una importante relevancia social dada su configuración como centros que ofrecen una variada gama de actividades culturales, sociales y económicas. Al mismo tiempo, es patente el interés de los Estados por regular las diferentes manifestaciones culturales desarrolladas en sus territorios, hecho que tiene como consecuencia inmediata la existencia de un importante entramado de normas jurídicas.
La conjunción de las circunstancias descritas determina que, para llevar a cabo una gestión correcta y cuidadosa de los museos, sean necesarios unos conocimientos jurídicos mínimos los cuales constituyan el objetivo de estudio de esta asignatura.

Presentation:
Within the framework of a Globalised World, this course will provide an international view on the legal aspects of cultural management. Therefore, and in order to satisfy the above-mentioned, it will be used both theoretical and practical approaches.
Aims:
The course will focus on the following two main issues:
- Good understanding of history and development of the legal protection of cultural heritage at the international level.
- Deep knowledge of the role of international organizations and rules in any discourse on removal and return of cultural objects.
Skills:
The student will have to become familiar with the international organizations involved in heritage conservation and will have to be able to deal with international legal tools in order to solve issues raised by the current practice.

PART 1. The envisagement of Culture on International Conventions.
1.1 Culture on International Conventions: First Steps.
1.2 Culture and International Organisations.
1.3 UNESCO and World Heritage: One example.
1.4 Council of Europe: Human Rights and Cultural Cooperation.
1.5 Main Conventions on Cultural Co-operation and Cultural Exchanges: the Spanish example.
PART 2. Culture and the European Union.
2.1 Culture: from the EC Treaty to the Lisbon Treaty. 2.2 Legal framework: the Cultural dimension in EC Law. 2.3 The European Agenda for Culture in a Globalising World.
2.4 First generation of cultural programmes and the new Culture Programme (2007- 2013). 2.5 Achievements and Challenges.
PART 3 Protection and trade of Cultural Goods.
3.1 Definition of Cultural Good. 3.2 The Protection of cultural goods on International Conventions. 3.3 The Protection of cultural goods on the EU Directive and EU Regulation. 3.4 The Protection of cultural goods on the Conventions of the Council of Europe 3.5 Present and future overview. Test cases.
PART 4 Public Contracts.
4.1 International Public Contract Law: WTO and UNCITRAL. 4.2 European Union Public Contract Law: EU Directives and 2010 annual work programme on grants and contracts for the Culture Programme.
PART 5 Culture within the Constitutional Legal Orders: Comparative Study
5.1 Spanish Constitutional Law . 5.2 Other examples: the EU Area. 5.3 Other examples: the USA, Mexico and Canada.
EVALUATION CRITERIA:
The overall mark will be set up according to: class attendance, active participation and a final exam which will consist on the resolution of a practical case. The attendance and participation will represent the 30% of the overall mark. Whereas, the final exam will count the 70%.
