Introduction

The course aims to provide students with in-depth knowledge of the areas to which it refers: psychopathological intervention in social and contentious-administrative jurisdictions.

The program will focus, on the one hand, on learning the specific characteristics of each of the jurisdictions to which the subject refers; and, on the other hand, it will deal with the specific and detailed study of the circumstances and pathologies that will be the object of study and that are necessary for professional practice in these areas. In this regard, the study will address both the bases of the expert report, as well as the circumstances and methodology necessary for the collection of data through anamnesis and that must configure the evidence and the expert report, up to the characteristics of the issuance of the expert report.


Objectives

Upon completion of the Master's degree, students must be capable and adequately qualified to obtain, develop and issue an appropriate expert report and be able to defend it before the competent bodies.


Learning outcomes of the subject

  • The graduate will be able to apply the acquired knowledge to the resolution of problems in new or little-known environments within broader (or multidisciplinary) contexts related to his/her area of study

  • The graduate will be able to integrate knowledge related to the formulation of judgments based on information (possibly incomplete or limited) that includes reflections on the social and ethical responsibilities linked to the application of his/her knowledge and judgments.

  • The graduate will be able to prepare/interpret forensic expert reports in the Civil, Family, Criminal, Social, Labor, Contentious-Administrative and Canonical fields. The graduate will be able to carry out the defense and questioning of the psychopathological-forensic expert report in the Oral Trial before the Courtroom in the competent courts.

  • The graduate will be able to detail the concepts of psychopathology applied to the forensic and judicial field. The graduate will be able to assess the case study by using psychopathological concepts considering the what, how, when, where and why of the cases

  • The graduate will be able to communicate in an understandable manner, orally or in writing, the scientific-technical psychopathological-forensic and/or legal knowledge in relation to psychopathological aspects in the legal field

  • The graduate will be able to examine documents with legal-criminal relevance related to psychopathological aspects (sentences, orders, medical-forensic and expert reports)

  • The graduate will be able to apply abstract legal categories to specific cases, so that the scientific-technical and legal knowledge in the matter are adequately related

Syllabus

First, the program will be presented to help the student to understand the content of the program and understand the reason for each topic.

We will learn about the "Medical Evaluating Courts", their composition and methodology. The ICAM. It will deal with the study and differentiation of the various types of "contingencies", "temporary disability", "permanent disability", "benefit for risk of pregnancy", "maternity and paternity leave" and "leave for treatment of a minor with cancer or serious illness".

We will then proceed to analyze what is the "clinical history" in the expert report, with particular emphasis on the methodology of the questioning of the expert, as well as the significance, value and assessment of the data collected during the course of the anamnesis and psychopathological exploration.

The development and presentation of the expert report will occupy a session in which the praxis of each point presented in it, methodology and its specific weight will be addressed in detail. Psychodiagnosis as a technique for studying the expert that complements psychopathological exploration acquires a significant importance, deserving of a session in which we will analyze quantitative and other qualitative techniques, with their limitations and applications, eminently practical aspects. Various techniques for analyzing the expert will be considered, as well as the choice of tools, applications and evaluation of the results, with special emphasis on the detection and discrimination of the simulator and/or the person who has assumed the role of the patient.

 

A session will be devoted to a detailed analysis of the specific characteristics of the expert study, the issuance and presentation of the expert report before the Contentious-Administrative Jurisdiction and to the knowledge of its peculiarities.

The student will then have the opportunity to address the knowledge of the Ecclesiastical Courts, their idiosyncrasies and the particularities of the expert examination and the issuance of an expert report in this jurisdiction.

In what is, in a way, a more specific second part, the specific study of the expert reports is carried out with respect to the various pathologies that the student may encounter in the development of his work: Particularities of the expert report in Common Contingencies and in Work Accidents to move on to Personality Disorders, Mental Weakness, Dementia in its various forms, Epilepsy, Workplace Harassment, Anxiety Disorder, Post-traumatic Stress Disorder, Depressive Disorder, Alcoholism, Addictions and Drug Addictions, Schizophrenia and Bipolar Disorder, Organophosphate Poisoning and Multiple Chemical Syndrome.


Teaching and learning activities

Since during the academic year the student already has access to various subsidized centers in which an extensive program of practices is developed for a minimum of two weeks each student, the classes have an eminently theoretical-practical character; that is, from the theoretical bases essential for the good knowledge and exercise of what will be the training referred to in the Master, the presentations of the classes will be developed at all times through practical cases and discussions on the subject.

Normally the classes will be developed with PowerPoint projections duly prepared for this purpose.


Evaluation systems and criteria

1. Class attendance. A minimum of 80% attendance at face-to-face sessions will be required in order to be assessed and successfully pass the course. With an overall class attendance average of less than 80% but greater than 60%, the coordinating professor of the course may require the student, as a requirement to be able to be assessed, to carry out some additional work or practice of sufficiency. In no case, with an average class attendance of less than 60%, no student will be able to be assessed and the course will be considered not passed, having to attend the second call.

2. Continuous assessment. The assessment of external practices (Directed Case Study) and of the eventual works and practices of the course will represent 30% of the final grade of the course.

3. Final exam of the course. It will consist of a final multiple choice exam that will represent 70% of the final grade.

The final exam will consist of 50 multiple choice theoretical questions on the knowledge covered in the course syllabus. The questions will have 4 answers and only one will be valid.

If the student has attended 60-80% of the classes, he or she must submit a paper in order to be assessed. This paper will consist of a properly developed expert report, which must include a differential diagnosis with the corresponding bibliography and the pertinent medical-legal conclusions. This paper must be submitted at the end of the course's teaching period, on the date and in the manner that will be announced.
