The Faculty of Law at UIC Barcelona and Rödl & Partner are organising, as part of the Master’s Degree in Cybercrime and the Postgraduate Degree in Compliance and Cybersecurity, a seminar entitled: “Access to and registration of electronic devices and internal corporate investigations”.

This event will explore practical issues of great importance with regards to the use of Information and Communication Technologies (TICs) in internal corporate investigations and the implementation of compliance systems.

The weight of digital evidence in criminal proceedings continues to grow at a time in which the digitalisation of communications and information has spread to all areas of business and permeated the lives of the people who interact with them. In this context, there are a series of questions surrounding the collection and validity of evidence that are yet to be answered.

This seminar will analyse the extent to which Spanish Supreme Court judgement no. 489/2018, of 23 July, has brought clarity to a legal debate marked by confusion and disparate criteria.

The event is intended for students from the Master’s Degree in Cybercrime, lawyers, compliance officers and anyone interested in the subject.

4.15 p.m. Opening address by Pilar Fernández, dean of the Faculty of Law; Joaquín Echavarri, partner at Rödl & Partner; and José R. Agustina, director of the University Master’s Degree in Cybercrime.

4.30 to 5.10 p.m. Inaugural lecture: “Problematic questions in internal corporate investigations: Fundamental rights and judicial guarantees in collecting digital evidence”, by Eloy Velasco, magistrate in the National Court of Spain and president of the Advisory Council for the University Master’s Degree in Cybercrime.

5.10 to 6 p.m. Round table: “Legal constraints on access to electronic devices in light of the Bărbulescu case and Supreme Court case law”.

Moderated by: Joaquín Echevarri, partner at Rödl & Partner, and Rodolfo Tesone, president of ENATIC.
